Terms of use

These terms govern your use of the website at glasstorches.com. In them, "GlassTorches.com", "we", "us" and "our" mean the operator of this site, and "you" means anyone who visits it or sends us anything through it. By using the site you agree to these terms. If you do not agree, please do not use the site.

These terms incorporate our disclaimer (the safety, accuracy and image notices) and our privacy policy. Together they are the whole agreement between you and us about the site.

Who may use the site

The site is written for adults who work with, or are shopping for, glassworking torches. It is not directed to children under 13, and if you are under 13 you may not send us a message or a review. If you are under 18, use the site only with a parent or guardian involved.

Information only, not professional advice

Our content is general information to help you research and compare glassworking torches. It is not professional, engineering, safety, legal, or purchasing advice for your studio, your equipment, or your situation, and reading it does not create any professional relationship between you and us.

Safety and assumption of risk

Glassworking involves open flame, high heat, fuel gases, compressed gases and oxygen, all of which can cause fire, explosion, burns, eye injury and death. The manufacturer's instructions for your exact torch, regulators, hoses and gas supply always take precedence over anything we publish, and so do the fire, building and gas codes where you work. Use the flashback protection your torch and gas supply call for, eye protection rated for the glass you work, and ventilation, and have a gas supplier or qualified installer set up or check anything you are not trained to set up yourself. You are responsible for your own safety and for the safety of your studio, and you use any information on this site at your own risk.

Specifications, prices and accuracy

Figures come from the manufacturer's own pages and manuals where we have them, and are labelled as estimates where they are ours. Prices are reference figures and change without notice. Confirm the current spec and price with the maker before you buy. We work to keep the site accurate, but we do not promise that any information is complete, current or free of errors, and we may correct or change it at any time.

Using our content

The articles, comparisons, data, diagrams and design of the site are protected by copyright and belong to us or to the people who licensed them to us. You may read, print and save pages for your own use, link to any page, and quote short passages with a link back to the page you quoted. Search engines and other automated agents may crawl the site as our robots.txt file allows. You may not republish substantial parts of the site as your own, remove copyright or attribution notices, or sell our content without our written permission.

Things you may not do

• Use the site for anything unlawful, or to harass, threaten or impersonate anyone.
• Submit a review or message that is fake, that you were paid or rewarded to write without saying so, or that is about a torch you have not used.
• Send spam, automated form submissions, malware, or anything meant to disrupt the site or its host.
• Try to gain unauthorized access to the site, its hosting account, or any data behind it.
• Frame the site, or present our content in a way that suggests we endorse you or your products.

Reader reviews and other submissions

You keep ownership of the reviews, messages and corrections you send us. By sending one, you give us a non-exclusive, worldwide, royalty-free license to publish, display, reproduce and distribute it on the site and in the site's feeds and structured data, and to edit it only as our review standards below allow. You can ask us to remove a review at any time through the contact page, and we will take it off the site; we cannot recall copies that search engines or other sites have already made.

When you send a review, you confirm that:

• you have used the torch yourself, and the review is your own honest opinion of it;
• you are not being paid, and have not been given anything, in exchange for the review, or if you were, you say so in the review;
• you say in the review if you work for, sell for, or are related to someone at the torch's maker or a seller of it, or if you received the torch free;
• the review does not copy anyone else's work, and contains nothing defamatory, unlawful, or private about another person.

Our review standards

The editor reads every review before it appears. We publish every review that meets these standards, whatever its rating, and we never decline or remove a review because it is negative. We do not pay for reviews, offer anything for them, or ask only satisfied buyers to write them. A review is declined, or removed later, only if it:

• contains defamatory, harassing, abusive, obscene, vulgar, sexually explicit or discriminatory content;
• contains someone else's personal information, or trade secrets or other confidential information;
• is clearly false or misleading, or we reasonably believe it is fake or was not written by someone who used the torch;
• is wholly unrelated to the torch it was submitted for, or is a duplicate;
• was sent by the person who wrote it with a request to take it down.

Before a review is published we edit it only for length, to remove a link to or the name of a dealer, and for punctuation. We never change a rating or what a review says about the torch. A review that discloses a connection to a maker or seller is published with that disclosure intact. Reviews are the opinions of the readers who wrote them, not ours.

Affiliate and external links

Links to other sites are plain editorial links; we are not currently enrolled in an affiliate program (see our affiliate disclosure). We are not responsible for the content, products, prices, or policies of other sites.

Trademarks

Torch names, maker names, brands and logos belong to their owners. We use them only to identify the products we write about (nominative use), and that use does not imply that any owner endorses or sponsors this site.

Copyright complaints

If you believe something on the site infringes your copyright, send a notice through the contact page, choosing "Image or content permission" as the topic, and include:

1. your name and contact details (postal address, phone number and email);
2. the copyrighted work you believe is infringed;
3. the page address and a description of the material you want removed;
4. a statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law;
5. a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act for the owner;
6. your physical or electronic signature (typing your full name is enough).

These are the elements listed in 17 U.S.C. 512(c)(3). We review every notice and remove or disable material that we find infringes, usually without waiting for a full legal claim. If material you submitted was removed and you believe that was a mistake, you can send a counter notice through the same form with the elements listed in 17 U.S.C. 512(g)(3). We stop accepting submissions from anyone who repeatedly submits infringing material. Image owners who simply want a credit changed or a photo removed can ask the same way; see the disclaimer.

If someone brings a claim against us because of a review or message you submitted, or because you broke these terms or the law while using the site, you agree to cover our reasonable costs of that claim, including reasonable legal fees, to the extent the law allows.

Governing law and where disputes are heard

These terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict of law rules. Any dispute about the site or these terms will be heard in the state courts located in Buncombe County, North Carolina, or in the United States District Court for the Western District of North Carolina, and you and we both agree to those courts. If you live in a country whose consumer law gives you the right to bring a claim in your own courts, or under your own country's mandatory rules, nothing here takes that right away.

General terms

• Severability. If a court finds part of these terms unenforceable, that part is limited as little as needed and the rest stays in effect.
• No waiver. Not enforcing a term at one time does not give up the right to enforce it later.
• Transfer. We may transfer the site and these terms to a business entity that operates the site or to a successor, which then takes our place under them. You may not transfer your rights under them.
• Ending access. We may stop offering any part of the site, or block access by anyone who breaks these terms. The sections on submissions, warranties, liability, indemnity and governing law continue to apply after that.

Changes to these terms

We may update these terms. The date at the top of this page shows when they last changed, and a change applies from that date onward, never to a dispute that arose before it. If you keep using the site after a change, the updated terms apply to that use.
